Representatives and LaBelle's lawyer did not immediately respond to the lawsuit filed by Kevin and Roseanna Monk.
The couple lives in a Manhattan building where the Grammy-winning singer stayed for a while as presented in the Broadway musical "Fela!" late last year, said the Monk's attorney, Samuel L. Davis.
Davis said Roseanna LaBelle reproached Monk let his daughter a year and a half away from her as the mother tried to move luggage and a car seat in the lobby of the building on November 11, 2010. Monk took the girl and told LaBelle that was not his business to what the singer responded by throwing the bottle with water and insulting his mother.
The little girl began to mourn and Roseanna Monk said something to LaBelle, the singer in tonka was against her and tried to beat her, Davis said.
The Monk family filed a complaint with the police, but no one was arrested.
The lawsuit, which seeks compensation for damages, was filed five months after a military school cadet at West Point LaBelle sued by a fight in the Houston airport with the guards of the singer.
The cadet said he was attacked for no reason in March 2010. The singer countersued the cadet and said he tried to enter his limousine and he was drunk, plus it insulted with racist remarks, which he denied the young man.
Davis said Roseanna Monk LaBelle had asked to apologize and make a donation to an organization supporting children with cancer, but the singer ignored him. Monk's family believes that "someone has to show that even if it is a diva can not attack and terrorize ordinary people in the building," said the lawyer.
